Description of Service
FallPath is a software platform for manifest, tandem booking, waivers, logbook, wallet, marketplace, reporting, analytics, weather and planning workflows. FallPath is not a drop zone, skydiving school, aircraft operator, instructor, rigger or party to any jump, lesson, tandem experience or gear inspection.
Eligibility
Skydiving is inherently dangerous. FallPath does not verify age, licence level, medical fitness, currency, skill, legal eligibility or readiness to jump. Each DZ is solely responsible for waivers, eligibility decisions, local rules, student status and operational approvals. App check-ins, credential displays, warnings or profile information do not mean a person is fit or eligible to jump.
Safety and Advisory Features
Jump run headings, exit points, landing pattern displays, weather data, winds aloft, wing-loading calculations and warnings are advisory only. Final authority rests with the pilot, DZ, S&TA, instructor, coach and jumper as applicable. Skydiving carries risk of serious injury or death, and use of FallPath does not reduce, eliminate or transfer that risk.
Accounts and Security
Users must provide accurate account information, keep credentials secure and notify FallPath promptly of suspected unauthorized access. DZ operators are responsible for managing staff permissions and removing access when roles change.
Payments, Wallet Balance and Fees
Stripe processes payments, payouts, subscriptions and marketplace transactions. Wallet balance is not a bank deposit or an insured financial product. Weather-related cancellations receive a full refund or rebooking. Subscription cancellations take effect at the end of the billing period, with no partial refund except where required by law.
Content You Provide
Users remain responsible for logbook entries, waivers, signatures, photos, messages, marketplace listings, incident reports and other content they submit. You grant FallPath the rights needed to host, display, process, transmit and back up that content to operate the service. Signed logbook entries and waivers are intended to be immutable once finalized and should not be altered by any party, including FallPath, except through a defined correction or legal process.
Prohibited Conduct
- Providing false jump, waiver, identity, incident, marketplace or payment information
- Circumventing identity checks, payment flows, security controls or access permissions
- Selling stolen, counterfeit, recalled, unsafe or misrepresented gear
- Harassing users, staff, DZs, coaches, buyers or sellers
- Interfering with platform security, scraping, abusing APIs or attempting unauthorized access
Marketplace
Buyers and sellers are responsible for verifying gear ownership, condition, compatibility, legality, shipping, inspection and suitability. Riggers are independent third parties and are not employed, supervised or guaranteed by FallPath. DZ/coach references or vouches are voluntary trust signals, not FallPath verification or a guarantee of gear condition.
Third-Party Services
FallPath may rely on providers such as Stripe, Cloudflare, weather data providers, email providers, hosting/storage providers, mobile app platforms and error-monitoring tools.
Disclaimer of Warranties
FallPath is provided on an AS IS and AS AVAILABLE basis to the maximum extent permitted by law. FallPath does not warrant that the platform will be uninterrupted, error-free, accurate for safety decision-making, or suitable for any specific jump, DZ operation or gear transaction.
Limitation of Liability
To the maximum extent permitted by law, FallPath is not liable for injury, death, property damage, lost gear, lost profits, business interruption, incorrect safety decisions or skydiving activities conducted by independent DZs, pilots, instructors, coaches, riggers or users. FallPath's total liability to you is limited to the greater of CAD $100 or the amount you paid FallPath in the 12 months before the claim arose, except where a higher amount is required by law.
Indemnification and Termination
Users and DZs may be required to indemnify FallPath for claims arising from their misuse, content, DZ operations, gear listings, payments, violations or unsafe conduct. FallPath may suspend or terminate accounts, listings or access for policy violations, fraud, safety concerns, legal risk or nonpayment.
Disputes, Governing Law and Changes
These Terms are governed by the laws of Ontario, Canada. If FallPath restructures under a Delaware or other U.S. entity, this section will be updated accordingly. FallPath may update these Terms from time to time and will provide notice of material changes as required by law.
